With a view to the Legislation direct in the first mentioned Despatch I referred to, which you enclosed, I now forward the above Documents to the Acting General Attorney whose Opinion I enclose.
& seems to me that the Cases with China and Japan are precisely similar, and I therefore agree with M. Kingsmill that Legislation, if necessary, is necessary for both Countries.
An Ordinance to meet the Japan requirements would draw public attention to the absence of like enactment for China, and inconvenience might arise.

Under these circumstances I do not see my way clearly to the required Ordinance, and consequently await further instructions on the subject.
I should add that I mentioned the matter to her General Alcock before he proceeded to Japan, who was unable to advise me in the difficulty.
