After discussion, it was unanimously resolved that, with due regard to the interests and necessities of the Public Service, the Council could not advise His Excellency to rescind his former decision; and Council further considered it only reasonable for the Chief Justice, under the present peculiar circumstances of the Colony, to withdraw his application.
The Honorable The Colonial Secretary was instructed to write accordingly to the Chief Justice.
"Saturday, 16 April, 1859.
It was unanimously resolved, that the Honorable The Chief Justice be allowed 18 months' leave of absence to England, on Medical Certificate; such leave to commence from the 28th Instant.
His Excellency The Governor moved that, on the departure of the Chief Justice and pending the approval of Her Majesty's Government, the Honorable the Acting Attorney General be provisionally appointed to discharge the duties of Chief Justice of Hong Kong.
His Excellency The Major-General Commanding concurred in the motion.
