Under our existing systems of law and administration, the most terrible duty. imposed on any Minister of the Crown' is that imposed on the Home Secretary- of deciding in the case of death sentences whether or not his Majesty should be advised to exercise his prerogative of mercy;
It is difficult as well as terrible duty. The considerations that have to be weighed e many; each case presents its own individual difficulties, and ch case, must be decided of its own parti- cular merits. Moreover, the Home Secres | tary must always remember that he is an administrator and not an autocratie legislator that he must be guided not by his own private opinions, but by the law as it is, and that the power to change it is not in him, alone..
Every death sentence comes up for cun sideration by the Homs Secretary. On his table there is a stand containing cards.on which are inscribed the names of persons under sentence of death, with the dates of conviction and sentence, the probable date of execution, and the date And result of the appeal to the Court of Criminal Appeal, if any, That stand is always there, reminding the Home Secre tury that, so long as any one of the l cases is undecided, consideration of it must take precedenes bf any work, how- ever important.

All possible information regarding the history and relations of the persons concerned tast lie obtained and the judge who

And when all that is done, when thei views of the learned judge are known. if he thinks it right to expread them and does express them, and when the in- estinable advies and assistance of the permanent officials, which their great ex- perience enables them to give. have been given, the harden of the final decision rests on one individual alone.

To any oge holding the position of Home Secretary the very important ques- tion must constantly present [self whe ther our present method of advising his Majesty us, to the exercise of the pre- rogative of mercy is right. It can truly be described as a very important ques
tion:
For the effectivà administration of the criminal law, as of all law, nothing is more essentially vital than public con- fidence. To lose that public confidence in any degree would be a great national misfortune, and if, in any department of criminal administration, there is any ground for doubt, however small, steps should be taken to ensure its retention."
In the past criticisms on the action of Home Secretaries in the matter of death sentences have not been frequent, but they have occurred, and undoubtedly there have been cases where se section of the public have felt very grave mis givings, and doubted whether the sen- tence ought to have been carried out.
It is inevitable that such cases should happen, and as the death sentence when carried out is irrevocable, it is also in- evitable that such cases, when they occur, should give rise to deep and bitter feel- ing. It is equally true that there is a growing tendency in the public to take an intelligent as distinct from a morbid interest in criminal trials, and in con- sequence a greater and more effective in terest in the execution or non-execution of the sentence.
VALUE OF PETITIONS.
It is, no doubt, illogical, but every Home Secretary has been obliged to con- sider the effect upon public opinion of carrying out the sentence of death. It has been a guiding rule that where public horror at the execution would out.
