An Ordinance enacted by the Governor of Hongkong, with the Advice of the Legislative Council thereof, to amend Ordinance No. 9 of 1857, in relation to the Issue of Passes for Chinese and to provide for the better Security of the Residents of the Colony. WHEREAS it is expedient to amend Ordinance No. 9 of
1857, in relation to Passes for Chinese and to provide for the better Security of the Residents of the Colony: Be it enacted by the Governor of Hongkong, with the Advice of the Legislative Council thereof, as follows:-
I. Sections II, III, IV, V and XI of Ordinance No. 9 of 1857, are hereby repealed.
II. From and after the Passing of this Ordinance, Passes for Chinese shall be issued by the Superintendent of Police in such Council as to Form and for such Periods, and under such Regulations, as the Governor in Council may, from Time to Time, by any Orders to he published in the Gazette prescribe and direct.

III. Until such Orders of the Governor in Council shall be made and published as aforesaid, it shall be lawful for the Super- intendent of Police to issue Passes for each Quarter of every Year in the Form contained in the Schedule hereto, with such Modifi- cations as the circumstances of each Case may require.
IV. The Superintendent of Police shall cause a Register of Passes to be Night Passes to be kept in which the following Particulars shall kept.

1. The Name and Address of the Person to whom Passes
have been granted.
2. The Locality of the Establishment in respect of which
they shall have been granted.
3. The Number of Passes issued.
4. The Period for which the same were issued.
5. Any other Particulars which it may be expedient to
record.
V. No Applicant shall, without the Order of a Magistrate, be entitled to a greater Number of Passes for the Use of his Esta- blishment, than the Superintendent of Police shall deem reasonable. VI. The Superintendent of Police may, upon reasonable refuse Passes. Grounds, refuse to issue Passes to any Applicant, without the

VII. The Superintendent of Police may, upon reasonable rescind Passes. Grounds, call in and rescind any Pass issued by him before the Expiration of the Period for which the same shall have been granted and any Person who shall without reasonable Excuse, the Proof of which shall lie upon him, refuse or neglect to return such Pass on Demand, shall be liable on Summary Conviction thereof before a Magistrate, to a Fine not exceeding One hundred Dollars for every such Pass.

VIII. Every Chinese who shall, without reasonable Excuse, the Proof of which shall lie upon him, be found at large between the Hours of Eight in the Evening and Sunrise or between such other Times as may be specified by any Regulations to be made under Section II:-
1stly. Without a Pass issued in Conformity with this Ordi-
nance, or:
2ndly. With a Pass which shall not have been issued to him, or which he shall not have been authorized to use by the Persons to whom the same shall have been issued,
or:
3rdly. With a Pass, which shall no longer be valid by Rea- son of the Period for which the same was granted hav- ing expired;
shall on Summary Conviction thereof before a Magistrate, be liable to a Fine not exceeding Fifty Dollars with or without Im- prisonment with Hard Labor for any Period not exceeding Three Months, or to Public Exposure in the Stocks, for any Period not exceeeding Three Hours.
