Rules made by the Governor in Council under Section 17 of the Prison Ordinance, 1932, Ordinance No. 38 of 1932, on the 3rd day of October, 1938.

After Rule 2 of the Prison Rules on page 182 of the Regulations of Hong Kong, 1844-1925, insert the follow- ing:-

Commissioner.

3. The Commissioner shall, subject to the orders and directions of the Governor, have the administrative com- mand and direction of the prisons and prison officers of the Colony, and subject to the provisions of these Rules, may make such appointments, promotions, transfers and reductions. in ranks and grades of subordinate officers as he may see fit.

(2) The Commissioner may, subject to the provisions of these Rules and to the orders and directions of the Governor, from time to time frame orders and regulations for the observance of all prisen officers and may also frame orders for the general government of subordinate officers in relation to their appointment, dismissal, discharge, training, arms and accoutrements, clothing and equipment, places of residence, classification and particular services, as well as their distribu- tion and inspection, and may also frame such other orders and regulations relative to the said officers as he may deem expedient for preventing neglect or abuse, and for rendering such officers efficient in the discharge of their duties and for promoting discipline.

(3) The Commissioner shall periodically visit and inspect the prisons of the Colony.

(4) The Commissioner may delegate any or all of the powers conferred on or duties laid down for him by these rules to the Superintendent.

Rule 3 of the Prison Rules is rescinded and the following rule is substituted therefore and renumbered 3 (a).

Superintendent.

3.(a) The Superintendent shall be the officer in charge of the Hong Kong Prison at Stanley. He shall supervise and control all matters in connexion with the prison and shall be responsible to the Commissioner for the conduct and treat- ment of the prison officers and prisoners under his control and for the due observance by prison officers and prisoners of the provisions of these Rules and for all orders issued thereunder.
