I am directed to refer to your letter dated
21 February 1968 and to this office's letter of the 24th.

The causing of a television broadoast to be transmitted to the premises of subscribers to a diffusion service over wires, or other paths provided by material substance, will be an act restricted by the copyright in a telcvision broadcast. Please refer to subsection (2) of clause 4 of the Copyright Bill which should now be in your hands. This subsection is applicable to the relaying of television programmes under the licences referred to in sub-paragraphs (4)(i) and (d)(ii) of my letter dated 10 February 1968. It follows that the relaying of a television programme under either of those licences will be restricted by copyright.

You may, however, wish to consult your own legal advisers on the effect of the legislative provision to which reference has been made.
